DATA PROCESSING POLICY FOR VIDEO SURVEILLANCE PURPOSES

REFERENCE LAW: Art.13 EU Regulation 2016/679 ID: VDS-4-Full disclosure

In addition to the information provided to the interested parties by means of the signs displayed in the areas where video surveillance systems are in operation, it is communicated that:

• The processing of personal data through video surveillance systems takes place in accordance with current privacy regulations (EU Regulation 2016/679 "GDPR"; Legislative Decree 196/2003, as amended and supplemented by Legislative Decree 101/2018; General measures of the Guarantor Authority for the protection of personal data, expressly recognized by Art.22, paragraph 4 of Legislative Decree 101/2018)
• the registration of the images is carried out, as Data Controller, by Quam S.r.l.. in the person of the Legal Pro-Tempore Representative;
• the system is installed for SECURITY purposes and the use of cameras is aimed at protecting assets, persons and assets against possible intrusions, fires, thefts, robberies or acts of vandalism and the possible defense of the rights of the Owner in court (acquisition of evidence);
• access to or passage of the interested parties at the aforementioned entrances, rooms and spaces of relevance necessarily involves the shooting of images that may concern them;
• the detected images can be recorded and stored for the period of time strictly necessary to achieve the above purpose, and in any case for a time not exceeding the statutory deadlines (never exceeding 7 days), except for the longer period possibly necessary to comply with specific requests of the judicial authority or judicial police in relation to ongoing investigative activities; at the end of the expected retention period, the recorded images are deleted from their electronic, computer or magnetic media;
• the images can only be processed by formally authorized and educated personnel or by external companies that, as data controllers, collaborate in the maintenance of the plants and supervisory activities; they are not communicated in any way or disseminated outside the owner's structure, without prejudice to the execution of any orders of the judicial authority or judicial police or, in case of wrongdoing, the use in any judicial offices;
• the images will be treated with appropriate tools and methods to ensure an adequate level of security and confidentiality, with particular reference to the measures indicated by Art.32 of the GDPR and Provision on video surveillance - 8 April 2010 - Italian Privacy Guarantor;
• interested parties have the right to contact the Data Controller for any request for access to the videorecorded data concerning them, pursuant to Art.15 and below of the GDPR. In particular, the data subject, if it is in any case identifiable, has the right to obtain from the data controller confirmation of the existence or not of personal data concerning him, and their communication in an intelligible form; to know some news about their processing (origin of the data, purposes and methods of processing; identification details of the data controller and, if appointed, of the managers, etc.); to obtain the deletion or blocking of data processed in violation of the law; and to oppose, for legitimate reasons, the processing itself;
• The possible shooting of workers and use of video recorded images takes place in compliance with current regulations on labour law (Article 4 Law 300/70 "Workers' Statute", as amended by Article 23 of Legislative Decree 151/2015 "last implementing decree Jobs Act")

INFORMATIVA SUL TRATTAMENTO DEI DATI PER SCOPI DI VIDEOSORVEGLIANZA

A completamento delle informazioni fornite agli interessati per mezzo dei cartelli esposti nelle aree ove sono in funzione sistemi di videosorveglianza, si comunica che:

• Il trattamento dei dati personali mediante sistemi di videosorveglianza avviene in conformità alle vigenti normative in materia di privacy (Reg.UE 2016/679 “GDPR”; D.Lgs.196/2003, come modificato ed integrato dal D.Lgs.101/2018; Provvedimenti Generali dell’Autorità Garante per la protezione dei dati personali, espressamente riconosciuti dall’art.22, comma 4 del D.Lgs.101/2018)
• la registrazione delle immagini è effettuata, quale Titolare del trattamento, da Quam S.r.l. in persona del Legale Rappresentante pro-tempore;
• l’impianto è installato per scopi di SICUREZZA e l’uso delle telecamere è finalizzato alla protezione dei beni, persone e patrimonio rispetto a possibili intrusioni, incendi, furti, rapine o atti di vandalismo ed all’eventuale difesa dei diritti del Titolare in sede giudiziaria (acquisizione prove);
• l’accesso o il passaggio degli interessati presso i predetti ingressi, locali e spazi di pertinenza comporta necessariamente la ripresa di immagini che possono riguardarli;
• le immagini rilevate possono venir registrate e conservate per il periodo di tempo strettamente necessario al raggiungimento dello scopo sopra indicato, e in ogni caso per un tempo non superiore ai termini previsti per legge (mai superiore ai 7 giorni), salvo il maggior termine eventualmente necessario per adempiere a specifiche richieste dell’autorità giudiziaria o di polizia giudiziaria in relazione ad attività investigative in corso; al termine del periodo di conservazione previsto, le immagini registrate vengono cancellate dai relativi supporti elettronici, informatici o magnetici;
• le immagini possono essere trattate esclusivamente da personale formalmente autorizzato ed istruito o dalle società esterne che, in qualità di responsabili del trattamento, collaborano alla manutenzione degli impianti ed alle attività di vigilanza; non vengono in alcun modo comunicate né diffuse all’esterno della struttura del titolare, fatta salva l’esecuzione di eventuali ordini dell’autorità giudiziaria o di polizia giudiziaria o, in caso di illeciti, l’utilizzo nelle eventuali sedi giudiziarie;
• le immagini verranno trattate con strumenti e modalità idonee a garantire un adeguato livello di sicurezza e riservatezza, con particolare riferimento agli accorgimenti indicati dall’Art.32 del GDPR e Provvedimento Generale del 08/04/2010;
• gli interessati hanno diritto di rivolgersi al Titolare del trattamento per qualsiasi richiesta di accesso ai dati videoregistrati che li riguardano, ai sensi degli artt. 15 e seguenti del GDPR. In particolare, la persona interessata, ove sia comunque identificabile, ha diritto di ottenere dal titolare la conferma dell’esistenza o meno di dati personali che la riguardano, e la loro comunicazione in forma intelligibile;
di conoscere alcune notizie in ordine la loro trattamento (origine dei dati, finalità e modalità del trattamento; estremi identificativi del titolare e, se nominati, dei responsabili, ecc.); di ottenere la cancellazione o il blocco dei dati trattati in violazione di legge; nonché di opporsi, per motivi legittimi, al trattamento stesso;
• L’eventuale ripresa di lavoratori ed utilizzo delle immagini videoregistrate avviene nel rispetto delle vigenti normative in materia giuslavorista (Art. 4 L.300/70 “Statuto dei Lavoratori”, così come modificato dall’Art. 23 del D.Lgs. 151/2015 “ultimo decreto attuativo Jobs Act”)
